Amendments to NBCEI Main agreement |
steville | 1/28/2009
- WAGE NEGOTIATIONS 2009: AMENDMENTS TO THE MAIN AGREEMENT OF THE NATIONAL
BARGAINING COUNCIL FOR THE ELECTRICAL INDUSTRY OF SOUTH AFRICA
Attached is a copy(Click here) of the Amendment to the Council's Main Agreement which
has been signed by both parties following the wage negotiations for 2009. As the Trade Union only signed the Agreement on 21 January 2009 it is most unlikely that it will be published in the Government Gazette until late
February or early March. Accordingly, until such time that it is published
it will be up to each individual member to decide whether or not they wish
to grant the wage increases earlier. Members will be informed immediately
it has been published.
It is very important to note the conditions that are attached to the
increases, which you will see after the wage tables in section 4 and in the
final paragraph of section 5(1). These arose following the intervention of
the Department of Labour last year when SAEWA was refusing to sign the
Agreement unless we agreed to back date the wage increases to 1 February
2008. You will recall that an additional percentage had to be added to the increase, which depended on the month it was granted, to ensure that they received an increase effective from February 2008.
What the provisos are saying is that if an employer was paying an employee
the prescribed minimum wage rate and did not grant the 9% increase in
February 2008, but gave it subsequently by adding the additional adjusting
percentage, then for the purposes of the new Agreement all such employees
will revert to the new prescribed minimum wage rates. As a result they will be below 11%.
Insofar as the guaranteed increases are concerned, the same will apply. For
the purposes of calculating the new wage increase, the wage will revert to
the wage an employee would have been earning had the 8,6% been applied to
his wage in February 2008, and not the wage that was adjusted with the
additional percentage. As a result they will receive below 9%.
I hope that this explanation is clear, but if not please contact your
Regional Director to discuss the matter.
Best Regards
Chris Greager
